User Agreement

This User Agreement ("Agreement") is a legally binding contract between you ("User", "you") and Cloud84, a technology firm operating Tender84.com ("Tender84", "we", "us"), for use of the Document Credit Service on tender84.com. By registering an account, accepting Welcome Credits, or purchasing a Credit Pack, you confirm that you have read, understood, and agree to be bound by this Agreement.

If you do not agree, please do not register or use the service.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law. The service is intended for contractors, suppliers, consultants, and procurement professionals operating in India.

2. Account Registration

Access to tender search and document requests requires a verified Tender84 account. You agree to:

• Provide accurate information (name, email, phone, company name, GSTIN where applicable)
• Keep your login credentials confidential and not share them with any third party
• Notify us immediately at [email protected] if you suspect unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

3. Document Credits

3.1 Welcome Credits

New registered users receive 15 Welcome Credits automatically upon account verification, at no charge. These credits:

• Carry the same value as purchased credits — one credit per document request
• Are valid for 1 (one) year from the date of account registration
• Are non-transferable and cannot be converted to cash
• May be revoked if fraudulent or duplicate account registration is detected

3.2 Purchasing Credits

Additional credits may be purchased via Credit Packs on the Plans or Checkout page. Credit purchases:

• Are priced in Indian Rupees (INR), inclusive of applicable GST
• Are added to your balance upon confirmed payment
• Are valid for 1 (one) year from the date of purchase

3.3 Credit Expiry

Credits expire 1 year from the date of grant or purchase. Expired credits are forfeited and cannot be restored. You will receive a reminder notification before expiry.

3.4 Credit Consumption

One (1) credit is deducted per document request at the time our team begins processing. Processing typically begins within 15–30 minutes on business days. No credit is deducted if a request fails due to a technical error on Tender84's side.

3.5 Refund of Unused Credits

Unused, non-expired credits may be refunded upon written request, subject to the following:

• Refund requests must be sent to [email protected] with your registered email and Order ID(s)
• Where GST has been charged on the original credit purchase and a GST return has been filed and tax paid by Cloud84, the GST component will be deducted from the refund amount
• The net refundable amount (credit purchase value minus GST deducted) will be returned to the original payment method within 7–10 business days
• Welcome Credits (granted free) are not eligible for cash refund
• Credits that have already expired are not eligible for refund

4. Document Request & Delivery

4.1 What We Do

Tender84 retrieves tender documents from official NIC GePNIC eProcurement portals and other government procurement platforms on your behalf. We are not a government portal and do not issue, modify, or authenticate tender documents.

4.2 What You Receive

Upon a successful request, you will receive the available tender document set (NIT, bid documents, BOQ, drawings, or specifications) delivered via email or your account dashboard.

4.3 Accuracy Disclaimer

Documents are sourced from the official portal at the time of retrieval. Always verify tender details — deadlines, eligibility criteria, and corrigenda — directly on the official government portal before submitting any bid. Tender84 is not liable for any loss arising from reliance on retrieved documents.

4.4 Cancellation of Requests

You may cancel a document request before processing begins. Once processing starts, the credit is consumed and cannot be refunded. For requests cancelled before processing begins, the credit is automatically restored to your balance.

5. Acceptable Use

You agree not to:

• Resell, redistribute, or commercially exploit documents obtained via Tender84 without our written consent
• Submit bulk requests using automated systems or bots
• Attempt to manipulate your credit balance through fraud, chargebacks, or duplicate accounts
• Share or transfer your account credentials or credit balance to any third party
• Use the service in a manner that violates applicable Indian law or government procurement regulations

Violations may result in immediate account suspension, forfeiture of remaining credits, and legal action where warranted.

6. Privacy & Data

Your personal data is collected and processed in accordance with our Privacy Policy. We do not store payment card or UPI details. All payments are processed by our PCI-DSS compliant payment partner.

7. Limitation of Liability

Tender84's total liability for any claim arising from the Document Credit Service is limited to the amount paid by you in the preceding 30 days. We are not liable for: missed tender deadlines, incorrect bid submissions, losses arising from retrieved documents, delays due to source portal unavailability, or any indirect or consequential damages.

8. Account Termination

• You may close your account anytime by contacting [email protected]. Unused non-expired credits may be refunded as per Section 3.5.
• We may suspend or terminate your account for breach of this Agreement, fraudulent activity, or abuse of the credit system.

Sections 3.5, 6, 7, 10, and 11 survive termination of this Agreement.

9. Relationship to Other Policies

This Agreement should be read alongside:

• Terms of Service — general platform use rules
• Privacy Policy — how your data is handled
• Refund & Cancellation Policy — full refund procedures
• Client Service Agreement — for paid expert services (bid filing, DSC, etc.)

In case of conflict between this Agreement and the Refund Policy for matters relating to credits, this Agreement prevails.

10. Amendments

We may update this Agreement at any time. Changes will be posted on this page with a revised effective date. Continued use after posting constitutes acceptance. We will notify registered users of material changes by email.

11. Governing Law

This Agreement is governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Una, Himachal Pradesh, India.
